TERMS / CONDITION These Terms and Conditions apply to all transactions on the Dzone2 website only and will be different to those made through eBay. The following words and phrases should be defined as below within these Terms and Conditions: The operator and the owner of the website, Dzone2 is also referred to as “the company”, ”we”, “our”, ”us”, “the website” User of the website is referred to as “you”, “your”, “user” Person who purchases any goods from Dzone2 is referred to as “Buyer”, “Customer” The acceptance of Buyer in regard to the Company's Offer under these Terms and Conditions which is legally enforceable and is referred to as “the Contract” The product that is agreed to be supplied to the Buyer with the confirmation of the Company is referred to as “Goods” In these Terms and Conditions, you should construe all reference to any statutory provision in the real time which may have been amended before. 2. Use of the website 2.1 User Account To buy goods and change personal data from our site, you have an access ID and password to login your own account. For registration, you should provide us all correct and complete data. You should update your detail when there is any change. Once you login to your account, you will be responsible to all activities from your account. You should prevent any unauthorized access of your account and to keep confidentiality (include keeping the password secure and confidential). Please contact us immediately if you find or suspect you account is/was used by others without your authorization. Dzone2 has the right to restrict your access to our web, terminate the account at any time. 2.2 Accessibility The accessibility of the website should not be interrupted by Dzone2 but subject to repairs, maintenance, or upgrade of services which may take place regularly. This is to maintain website accuracy and reliability or upgrade the function. Under such cases, your usage in our website may be affected or even occasionally suspended or restricted. We endeavor to lessen the impact. 2.3. User's conduct Person who uses the website must be in lawful act and purposes. You understand and agree not to use the website for any fraudulent purposes, causing annoyance, in breach of copy right, trademark, privacy; or with intention to involve with material which is obscene, defamatory, offensive; or other purpose which is considered inappropriate by Gunsroar-airsoft . Also, you must not damage or cause any interruption of our website or any intention to do so. If you fail to follow the above regulation, we reserve the right to claim you for any indemnification in any form of our losses. 3. Intellectual Property 3.1 Copyright and database rights Under the protection by Hong Kong SAR and international copyright and database right laws, all the content ( including Logo, Photos, Graphics, text, icons but not limited to them) in the website is the property of Dzone2 and our content supplier. You acknowledge and agree all intellectual property rights and copyright which are in part of the use of website are legally owned by Gunsroar-airsoft.You are only permitted to utilize the information from our website with our expressed authorization. You acknowledge and agree all available information from our website is only for your personal use without commercial purpose. You agree not to extract any parts of our website by any means for any purpose without the authorization by Gunsroar-airsoft. Also you agree not to publish or reuse the parts of the website in your own website/database/internet without the authorization by Gunsroar-airsoft. 3.2 Right to access You are licensed by Dzone2 for our website access but with limitation. The license does not allow you to do the following in our website: collect any product information (such as price, description); to extract information by data-mining, robots, framing techniques for logo and layout etc; use for commercial purpose or resale. We will terminate your license once we find any unauthorized usage. 3.3. Claims for Copyright and Defamation Dzone2 have no will and any attempt to infringe other parties' intellectual property. Please send us written notice by email, fax or mail in case you find us: • Infringing on other's copyright. • Posting any defamatory statement on the website. We will handle the claim and rectify the problem as soon as possible. 4.Order 4.1 Contracts After your submission of an order to purchase from Gunsroar-airsoft , we will send you an email to acknowledge we receive your order request but does not represent we have accepted the order. This order is only formally accepted by Dzone2 when we send you a Dispatch Confirmation Email to inform you that your order has been dispatched by us. A legally binding contract is formed when we accept your order and dispatch the ordered goods to you. There is no legally binding contract between Dzone2 and you if the orders have not been confirmed by a Dispatch Confirmation Email. • Availability of Goods Product availability will be shown in the website with the products. We endeavor to maintain appropriate stock level, having said that, products may be unavailable or withdrawn without prior notice in any reasons. During our processing of your order, you will be informed by email and refunded for the total order amount if the goods is not provided. No compensation will be liable by Dzone2 for any losses you may suffer if goods are not supplied, deemed faulty, damaged during delivery or not of a kind foreseeable by the supplier. 4.3 Delivery Estimated delivery time is shown for the available products on the website. Unless we have specified any date for delivery, buyer should receive goods in a reasonable period of time. Dzone2 are not responsible for any direct or indirect loss or loss of profits or otherwise caused by any delay in the delivery of the goods. Unless the delay is more than 30 days, buyer is not entitled to rescind the contract. 4.4 Missing Items Upon receipt of purchased goods, buyer should immediately inspect the goods and packaging to confirm what they receive is exactly what they have ordered. In the buy find any discrepancies or missing items, the buyer must report to us by email or fax within 7 days of receipt by you. You have to retain all packaging materials and submit a copy of the invoice you received with the product by email. 4.5 Refund We will not be liable for any direct or indirect losses you suffered in refund due to the fluctuation in exchange rates. If we refund your payment for any reasons, we will only refund the original amount with respect to its currency that we have received in our account. 4.6 The Risk and ownership of the goods All goods which the buyer ordered is owned by Dzone2 until we has received full (total sum due to Dzone2 for the goods itself and the related sum arisen from the buyer on any account) and final payment. Buyer bears all risks for the goods during delivery . Once the goods become the property of the buyer, the buyer should not destroy and tear off any marks and labels on the goods or the packaging; keep the goods in good condition and separate with other goods so that they are identifiable as the Companies' property. 5. Prices & Payment 5.1 Product prices Product prices in the website are the base prices excluding the delivery cost & insurance, VAT/GST/import tax and additional duty and custom that shall be payable by the buyers. However, all cost will be calculated and clearly shown in the checkout including the delivery cost & insurance, VAT/GST/import tax and additional duty and custom. This is the final price you need to pay for order and it will be shown on the Dispatch Confirmation Email. In the unusual situation of wrong pricing that should be found during order processing, we will charge the buyer the actual amount if the correct price is lower than the marked price. If the correct price is higher than the marked price, we will notify the buyer as soon as possible by email and reconfirm the order before dispatch, buyer can either cancel the order or buy at the correct price. We are not responsible to suffer any loss caused in this situation. 5.2 Payment Payment is due and should be withdrawn from your payment account at the time we issue the customer receipt and send you the Dispatch Confirmation Email. If you use Paypal for payment, you must follow the Paypal policy. Dzone2 accept your payment if you have confirmed address or you are verified by Paypal. For all the other situations, we may request your further action before we accept your payment. We have the right to reject your payment if it is suspicious or does not fulfill our requirement, we will then refund the original amount to you. You should update and familiarize yourself for Paypal policy before using it for payment. 5.3 Import Tax and Custom fee The transaction does not include any I mport Tax / Duty / VAT / Brokerage Fees / Handling Fees . For more information about the tax rate, please check with local custom department before purchases. If you reject the package as the customs have charged any tax or duty, we reserve the right to charge you the both ways shipping cost and 5% handling fee.
In some countries, applicable import duties might be imposed. We will put legal effort to minimize such fees. We do not promise but we try our best to reduce your tax or duty upon buyer's request. If the package is held in custom, please do not answer any inquiries from custom or provide any document without our advice. We will contact our shipper to clear the custom. If the package was returned due to refusal to pay import tax for shipment by the buyer or unsuccessful delivery (For example, insufficient address information, no such receiver), we will charge you the both ways shipping cost and 5% handling fee. Please feel free to contact us for any additional information. 6. Return Policy You can return your goods to us for refund or replacement within a period of seven (7) days. This includes the goods purchased as Christmas presents. You must notice us the return for refund or replacement by email, telephone, fax or letter of your intention.
You have the right to return provided that the following requirements and conditions are fulfilled.
• Completed Authorized Return form and order receipt are provided • Return within 7 days upon receipt of goods • Goods are in brand new conditions and in entirety.
We will provide an appropriate offer if the returned goods are deemed as used/ second-hand condition as the right of Gunsroar-airsoft
The processing time for return will be between 7 and 10 days.
We will not cover both postage in returning goods to us and sending you back the replaced item (If you choose to replace but not refund).
6.1 Damage and Faulty Goods Please contact us by email, fax or telephone immediately if you find the goods are damaged during the delivery or any obvious defect. (This is not applicable to the defect due to negligence, misuse or accident.) To claim for refund or replacement, you must notify us within 7 days upon receipt of goods and providing us authorized return form and order receipt. Postage (both cost for you to return and for us to send you back) will be reimbursed only if it is a manufacturing defect. We will arrange as soon as possible.
6. Miscellaneous
If the losses were foreseeable to both Dzone2 and you when you are using the website or the contract takes place for selling of goods, Dzon2 will be liable for any losses you suffer when we breach the terms and condition. But if the losses were not reasonably foreseeable to both Dzone2 and you when you are using the website or the contract takes place for selling of goods, Dzone2 will be exempt in liability for any kind of losses (not limited to a ny direct, indirect, incidental, consequential or economic loss) you suffer.
6.8 All statements or warranties in our terms & conditions are additional to your statutory rights. You unreservedly accept our Terms & conditions by sending us order request and we maintain once we confirm your order. Any disputes shall be adjudicated according to these Terms and Conditions which are governed by and interpreted according to Hong Kong SAR Law and the parties agree to submit to the exclusive jurisdiction of the Hong Kong SAR Courts. Term should be severed only if it is unenforceable by the jurisdiction. For any enquires or questions with our privacy policy, please contact us via email or by phone. We will take all reasonable precautions to keep your data secure. However we are not liable for any losses caused as a result of unauthorized access to information provided by you unless we are negligent. Collection of Information Dzone2 owns solely the information collected on the website and will be governed by the terms of the Personal Data (Privacy) Ordinance (“the Ordinance”) Different information is collected: • Contact information (Full name, Address, Email address, Telephone or Fax numbers) • Financial information (Credit card number, expiry date) • Tracking information ( details of your operating system, browser version, domain name, IP address and details of your website) Use of Information Membership You can choose to become our member by registering in our website for a user account. It is optional to you as it is not essential for you to buy from us. If you choose to become our member, after your registration, we will send you and all other members email or newsletter occasionally to update you with our latest promotion and news. Members can choose to opt-out the newsletter subscription when they register, or they can unsubscribe by replying to the original email/ newsletter. Also, all members have the right to close their accounts and we will delete their information from our server not later than 30 days. Order Processing: Information of the buyer will be collected in our order form. We collect buyer's information including contact name, email, delivery address and also the credit card information for billing and delivery only. Marketing and Promotion User demographic data will be collected if they join/opt-in our newsletter subscription. Also purchasing record will be collected to our members. These data will be used for research and analysis as well as marketing purpose. Cookies Cookies are the data/information automatically stored and placed in your computer drive. Aggregate information We share the aggregate information with our business partners. For instance, we share the number of click through by the users which come from their website. No personally data will be obtained and shared. Opt-out Users can always be provided opt-out function to their information which is not used at the point we are directly asking for. To best protect your important personal data (including credit card no and password) when inputting via our website, we adopt the best encryption software security socket layer (SSL) for 128-bit encryption to protect your information.
User Consent We provide 12 months warranty, which is valid from the dispatch date, after we have accepted the full payment of the purchased goods. However, our warranty does not cover consumable goods including batteries, power adaptors, software and accessories which are defined by Dzone2. This warranty also does not cover the damage of appearance/any scratch of the goods. We do not accept any warranty transferred to the third party. To claim for the warranty, Buyer's must: • provide the proof of purchases (payment receipt) • notify us with the product's item number. The warranty will not be covered for the below situations: 1. Damage caused by accidental or intentional damage, theft, fire, war, terrorism and natural disasters or any kind that is unforeseeable by Dzone2 2. Damage caused by Misuse: • Unauthorized modification or repair of the goods that is not approved by Dzone2 in advance. • Improper usage, handling or storage of the product. • The use of spare parts or changeable items, which are not recommended or produced by the manufacturing company, results in poor performance or damage. • Connection of the network, software, accessories or equipment to the product which is not approved by Dzone2 in advance. 3. Damage caused by Negligence: • Shock or fall, dust , dirt , dampness or corrosion, leaky batteries, repair or cleaning by unauthorized personnel • Damage caused by the intentional negligence of the buyer or anyone but not Dzone2. • Use without following the instruction of the manufacturing company or Dzone2. • Not installing any correction software provided by Dzone2. • Loss in data or damage file.
Dzone2 own the final right to determine if the returned goods are subject to the above situation(s).
You are suggested to take reasonable precautions such as backing up all the data and software so as to minimize the risk of loss or interruption when repair.
If we find the fault of your returned goods is not covered under this warranty, we have to charge the repairing fee with your written confirmation (we will contact you by email). Also the postage cost to return the goods to you will be at your account.
Postage and Repairing cost: 1. Within 12 month warranty period: If the goods are eligible to be covered by the warranty, Dzone2 will pay for the repairing cost and postage of sending you back the repaired goods. You only need to pay for the return postage of the defected goods.
If the goods are ineligible to be covered by the warranty (due to the above situation(s)), Dzone2 will only pay for the postage of sending you back the repaired goods. You will bear the return postage and the repairing cost (with your confirmation)
2. Beyond the 12 month warranty period: If you would like the goods repaired by Dzone2 even its warranty period expires, you will pay for all cost including all postage and repairing cost (with your confirmation) |
